Davido sued for defamation, breach of contract

Melody 911FMThe former President of the Nigeria Football Federation (NFF), Amaju Pinnick, has taken legal action against afrobeat musician David Adeleke, popularly known as Davido, accusing the artist of cyberbullying and defamation of character.
Mr Pinnick said Davido made incendiary posts against him on social media in October adding that since then, his life and that of his immediate family have been in grave danger and threat of physical bodily harm, injury and attacks.
The lawsuits followed altercations between the artist and Mr Pinnick in October after the musician failed to show up for an event he was paid to perform.
An investigation by Premium Times revealed how Davido’s company signed a performance agreement with BrownHill Event Inc, owned by Mr Pinnick, on March 30, 2023, committing the musician to performing in Warri on October 6. Amaju Pinnick
The contract was signed by the musician’s agent, Soso Soberekon, indicating the singer would perform for at least “55 or 60 minutes at the event.” Victor Wokocha endorsed the agreement for Brownhill, while a certain Cecil Bekederemo signed as a witness.
However, the 30-year-old musician was absent from the Warri event because he fixed another show in Australia (Melbourne) on the same day, October 6.
After failing to attend the Warri show, Mr Pinnick addressed and apologised to the event attendees in Warri, explaining to them that all contractual obligations and payments to secure the attendance of the artist were met but he still failed to show up.
Not long after, Davido took to the social media handles of Instagram, Snapchat and X (formerly known as Twitter) to post several posts reacting to Mr Pinnick.
In one post on Instagram, Davido said: “If I am returning any money, I will return it to any football charity organisation. In fact, I will double it. Mr Dream Crusher imagine how many Nigerian footballers have had their dreams crushed because a person wants to live for Ikoyi by force,” he said, allegedly referring to Mr Pinnick, who served as the president of NFF for eight years.
In another post, the musician responded to a video saying, “The man that dropped from the RR is Amaju Pinnick. He was NFF president for just eight years. He was charged for allegedly misappropriating $8.4 million paid by FIFA to NFF. I won’t mention allegations of unpaid allowances by players when he was the president. Let’s play a game.”
Mr Pinnick told a high court that these statements by Davido implied that the “former NFF president is a thief and is only able to live in Ikoyi because he crushed the dreams of several Nigerian footballers.”
“These defamatory publications and posts made by the artist when accorded their ordinary meaning portray me as a person deficient in character and integrity but also imbued with deceit, dishonesty, immoral, and fraudulent in the eyes of the right thinking members of the society,” he added.
The former NFF president went on to say due to the wide influence Davido has on social media, the singer has now subjected him to all forms of “cyberbullying, stalking, and harassment since the defamatory and incendiary posts.”
Mr Pinnick added that the singer posted the statements with the “aim of lowering the esteem of his person in the eyes of ordinary persons and generally bringing him to ridicule, derision and opprobrium.”
Why I wanted Davido to headline Warri Again show
In court documents seen by Premium Times, Mr Pinnick told the court that sometime in early 2023, Davido approached him to engage his services for the 19th edition of the “Warri Again” event that was held on 6th October 2023.
Mr Pinnick said he was hesitant to “engage the service of Davido because the musician had disappointed him in 2014 and 2019 editions of the “Warri Again” where the singer didn’t show up to perform after he had been paid for the events and he was compelled to make refunds thereafter.”
The FIFA Council Member said he believed the musician had turned into a “new leaf” so he decided to give him another chance. Mr Pinnick’s company, Brownhill Company Limited, entered into a performance agreement with the artist to perform as the headline artist of the 19th edition of Warri Again.
Mr Pinnick told the court that his company expended humongous resources on print and social media adverts for the event believing Davido would headline the annual show.
“Unfortunately, to the utmost humiliation and detriment of myself and my company, the artist willfully failed, neglected and refused to show up, attend and perform at the 19th edition of Warri Again,” Mr Pinnick said.
Davido, who broke onto the scene in 2011 had said he communicated to the organisers “months ago” that he was not going to be available. The singer added that “it’s a shame” they went ahead to continue promoting the show using his name.
Mr Pinnick told the court that “this statement is entirely false as Davido and his team never communicated or related such information to us.” Mr Pinnick said the singer did not even reply to a reminder letter sent to him on September 26, a week before the concert.
Instead, he said, the singer posted allegations that made him “suffer and endured severe irreparable reputational damages.”
Against this background, Mr Pinnick asked the court to compel Davido to publish on his “personal social media handles and in two national dailies APOLOGY to him for four consecutive days about the libellous statements about him.”
He also wants the court to restrain Davido or any of his agents from writing any false, malicious and unverified allegations against him.
Court documents show that a federal high court has granted Mr Pinnick an order to serve a writ of summons, statement of claim, and other accompanying processes as well as the Motion of Notice for Interlocutory injunction to the afrobeat singer.
The court also ordered “Davido to refrain from further posting, making and publishing any defamatory, derogatory, calumnious, and incendiary statement, story allegation and narrative about or against Mr Pinnick pending the hearing and determination of the motion on notice.”
The motion on notice is fixed for November 23 at a high court in Delta State.
Brownhill Event sued Davido
Meanwhile, Mr Pinnick’s event centre, Brownhill, has also sued Davido for allegedly breaching the contract agreement.
The group said the musician had disappointed them in the 2014 and 2019 editions of the “Warri Again” where the singer did not show up to perform after he had been paid for the events and he was compelled to do a refund of payments he collected for both events.
For this reason and others, the group said, Davido has been in the “habit of reneging on contracts and not showing up and he is also known to cyberbully, harass, and threaten those who call him out on his excesses or when he reneges on paid engagements.”
Brownhill Event Centre is now asking the court to grant an order directing Davido to refund the N70 million paid to him on 6th April for the performance at the 19th edition of the Warri Again event held on 6th October.
They are also requesting a court order directing Davido to refund $18,000 paid to charter the private jet that was to personally convey the artist and his team to Warri for the 19th edition of the Warri Again event.
Also, the company wants an order compelling Davido to tender a public apology on all his social media handles and in two National Daily Newspapers for four consecutive days to the organisation and attendees of the Warri Again programme.
The firm asked the court to order Davido to give them N2 billion as “General Damages” for breach of the performance agreement entered between the artist and the company.

Peter Okoye reacts to alleged song ownership by twin brother

Melody 911FMIconic Nigerian singer Peter Okoye has responded to allegations made by his twin brother Paul over ownership of a new song “Winning.”
Peter Okoye shared a detailed account of the song’s creation, clarifying his role and collaboration with others, including Ghanaian producer Vampire and songwriter Calypso.
He questioned Paul’s claims, citing their agreed-upon creative process and Paul’s removal of his (Peter’s) vocals from joint songs.
Peter also addressed his temporary break from music, stating he took time to recharge before returning with “Winning.”
He wrote on X: “If you have followed my journey as a solo artiste and even before, you will notice that I give people their due credit where necessary as I am a firm believer in teamwork; I know my strengths, where I need assistance or guidance I am not afraid to ask or work with those who are strong in the areas I am not; this includes the process of creating music, executing concepts and ideas etc. I will always credit people for their contributions to my projects.
“Sometime in June 2022, I stumbled upon a producer based in Ghana named Vampire, and my team and I also personally reached out to him via DM, that I liked his work and was interested in working with him. Before getting him to Lagos, I presented the idea of this producer to my twin brother and our team, getting their buy-in before I got him flight tickets and flew him to Lagos.“
It was when he got into Lagos I asked if he would be open to working on P-SQUARE’s next album project, that the 5 songs I had penned down from my end to be presented to our A&R team for the album project were: JAIYE, WINNING, FIND SOMEBODY, LEGENDARY, and ATTENTION, based on tracks he had produced.
“We started with my own 5 songs that needed to be submitted for PSQUARE’s album, which he produced for me: The idea for WINNING came from one of his beats that I discovered. I came up with the idea of changing the chord progression from the original version to what it is today with my own producer Goldswarm who is the co-producer of the song WINNING.
“I had also engaged a songwriter known as CALYPSO who wrote and composed the song WINNING and sent it to me on the beats through a voice note. And we started working on the song. Mind you, he worked on some other songs that were to make the album as well, so my brother was aware of his input to the production as we were all in the studio during this period.
“Then when my twin brother heard the song WINNING, which we had already created the hook/chorus for, he then wanted to start creating a verse. Our agreed-on process for each song presented by us was: arrange the song, leave a verse for the other person, then we both harmonise the chorus and refrain bits together. He wasn’t supposed to until Calypso and I finished it as part of my own song submission to the LEGENDARY ALBUM.
“After that, we finished and shared verses among ourselves. I do not wish to get into details of why the album didn’t see the light of day till date but it takes a different level of psychosis for one to steal what is theirs already; as since the release of this song, I have been labeled and called all sorts online and they have even gone as far as asking for the song to be taken down on various platforms, to what end?
“It was never part of his 5, now 6 (according to him) songs for submission, yet when he felt I was not interested in making music because I chose my sanity over the constant berating and drama that seemed to come up over creative direction in the group.
“If it were his song, why do I have all the music data including initial conversations and picture/video evidence on the above-mentioned titles/songs? Which of his songs do I have its data in my possession in that case? All because he was hoping for me to quit music. Even when I learnt that he had removed my vocals on songs we did together, suggesting that he sing the entire songs including the ones that he planned to present for the album without my input (a very absurd idea as we both make up the duo not just the one), but we both perform them on stage, I begun to have a rethink of the entire situation. Let me leave this here.
“Maybe because I was not posting anything music-related on my social media page for over 4 months. He believes I have lost interest in music. I took a breather to get my mind and head in the right space and when that was done, my epiphany was WINNING!”.

Pastor Love jailed 48 months in hard labour for stealing

Melody 911FMPastor Hammond Love, widely known as Pastor Love, has been convicted of theft and sentenced to 48 months in prison with hard labour.
GBC Ghana Online reports that Pastor Love, a former husband of gospel musician Obaapa Christie, was found guilty of the offence after seven years of trial.
Before he was sentenced, Pastor Love pleaded with the court for mercy, adding that he was willing to pay any fine that would be imposed on him.
The court presided over by Isaac Addo, took into consideration the fact that the convicted Pastor Love was a first-time offender.
The court held that as a Pastor, he was expected to hold a high level of integrity, especially in matters of trust, and therefore handed him the 48-month jail term as a fair deterrent.
The facts of the case as presented by ASP Frimpong was that in 2016 one Samuel Amankwah, a resident of the US, shipped a 4×4 vehicle into Ghana and tasked Pastor Love to clear it from the port.
The convict cleared the said vehicle with his money, after which the complainant told him to sell it for US$50,000 and deduct the amount he paid as duty.
Later, the complainant told Pastor Love to hold on with the sale of the vehicle as he would travel to Ghana and refund his money.
In April 2017, the complainant arrived in the country and contacted Pastor Love for his vehicle, but he could not produce it despite several demands.
The complainant complained with the Police and Pastor Love was arrested in May 2017.
During interrogation, the convicted Pastor Love told the Police that he secured a loan of GH¢40,000 with 20 per cent interest to clear the vehicle and was accruing more interest, so he sold the vehicle at GH¢80,000 without the consent of the owner and paid GH¢70,000 to the loan company.
Meanwhile, Pastor Love was unable to lead the Police to the said loan company to verify the claim and could not also tell who bought the vehicle.
